There is no general statutory overtime premium in Ireland. Check the written terms, collective agreement and any Employment Regulation Order or Sectoral Employment Order; working-time limits, minimum wage, Sunday compensation and public holiday rights still apply.
Overtime rates usually come from the employment terms
A contract may define normal weekly hours, when overtime starts, whether it needs approval and the rate or time-off arrangement. Some agreements use a flat rate, time-and-a-half, double time or time off in lieu, but none of those multipliers is universal for all Irish employees.
Sectoral and collective rules can set premiums
Employment Regulation Orders, Sectoral Employment Orders and collective agreements can set binding or contractual overtime terms for covered work. Identify the employee’s actual role and sector before applying a rate found for another industry.
Worked contract example
A contract sets normal hours at 39 per week and pays authorised overtime at 1.5 times a €20 hourly rate. Four authorised overtime hours would be €120. The €30 overtime rate comes from the contract, not a universal statutory formula.
The 48-hour average still applies
Overtime hours count as working time. For many employees the average working week cannot exceed 48 hours over the applicable reference period. A premium rate does not turn excessive hours into compliant hours.
Sunday and public holiday work are separate
Sunday work may require compensation if it is not already reflected in pay. A qualifying public holiday also carries its own statutory benefit. An overtime clause should not be assumed to absorb those rights unless the legal and contractual requirements are genuinely met.
Minimum wage and overtime
Overtime premiums are excluded from the reckonable components used to make up the national minimum wage. Payroll should identify normal pay and premiums clearly enough to check the underlying hourly rate.
Questions to ask payroll or HR
- What are my normal weekly hours?
- At what point does overtime begin?
- Must overtime be approved in advance?
- Is it paid, banked as time off or included in salary?
- Does a sectoral or collective agreement apply?
- How are Sunday and public holiday hours shown separately?
Estimate a separate public holiday benefit
If overtime falls on a public holiday, check the statutory holiday benefit separately.
Estimate public holiday payFrequently asked questions
Is overtime legally time-and-a-half in Ireland?
No. There is no universal statutory time-and-a-half rule; the rate usually comes from a contract, agreement or sectoral instrument.
Does my employer have to pay overtime?
That depends on the employment terms and any applicable agreement or sectoral rule. Working-time and minimum-wage protections still apply.
Does overtime count towards the 48-hour limit?
Yes. Overtime is working time and counts in the average.
Is Sunday overtime different?
Sunday work has a separate compensation framework if it is not already accounted for in the rate of pay.
Can overtime be included in salary?
A contract may address overtime within salary, but the wording, actual hours, minimum wage, Sunday rights and working-time limits must still be checked.
Are overtime premiums used to meet minimum wage?
Overtime premiums are not reckonable components for making up the national minimum wage.
